INTRODUCTION

These Terms and Conditions (“Terms”) govern your use of the website atlastime.net (the “Site”) and your purchase of watches, accessories, and other goods from Atlas Time Enterprise (“we,” “us,” “our”). By accessing our Site or placing an order, you agree to be bound by these Terms .

1. DEFINITIONS

When the following words are used in these Terms, they have the meanings set out below:

  • “Goods” – the watches, watch winders, accessories, and other products offered for sale on our Site.
  • “Order” – your order for Goods submitted through our Site.
  • “Terms” – these terms and conditions as amended from time to time.
  • “Site” – the website at the domain www.atlastime.net.
  • “Working Days” – Monday through Friday, excluding public holidays in Malaysia.
  • “Consumer” – an individual acting for purposes outside their trade, business, or profession .
  • “Event Outside Our Control” – events beyond our reasonable control as defined in Section 15 .

2. OUR CONTRACT WITH YOU

2.1 Age Restriction: Our Goods are age-restricted. By placing an Order, you declare that you are 18 years of age or over .

2.2 Order Process: When you submit an Order, this represents an offer to us to purchase the Goods. This does not mean your Order has been accepted .

2.3 Order Confirmation: We will confirm our acceptance by sending you an email (“Order Confirmation”). The contract between us (“Contract”) is only formed when we send you the Order Confirmation .

2.4 Order Accuracy: You can check and amend any errors before submitting your Order. Please take time to read and check your Order at each page of the checkout process .

2.5 Availability: All Goods shown on our Site are subject to availability. If we are unable to supply you with the Goods (for example, because they are no longer in stock), we will notify you by email and cancel your Order. If you have already paid, we will refund you the full amount .

2.6 Pricing Errors: If a product is priced incorrectly on our Site, we will verify the correct price before processing your Order . If the correct price is lower, we will charge the lower amount. If the correct price is higher, we will contact you to confirm whether you wish to proceed at the correct price or cancel your Order .

3. THE GOODS

3.1 Product Descriptions: Images of Goods on our Site are for illustrative purposes only. While we make every effort to display colors accurately, we cannot guarantee that your computer’s display accurately reflects the color of the Goods . Your Goods may vary slightly from these images.

3.2 Packaging: The packaging of Goods may vary from that shown in images on the Site .

3.3 Authenticity: All watches sold by Atlas Time Enterprise are 100% authentic and sourced from authorized distributors and trusted brands. Each watch bears the serial number of the original manufacturer .

3.4 Warranty Documentation: Where applicable, Goods are delivered with original manufacturer warranty documentation, provided such documentation is available from the brand .

4. PRICE AND PAYMENT

4.1 Prices: The price of Goods will be as quoted on our Site at the time you submit your Order. Prices may change at any time, but changes will not affect Orders we have confirmed .

4.2 Currency: All prices are in US Dollars (USD) / Euros (EUR) / Hong Kong Dollars (HKD) / Malaysia Ringgit (MYR). Payments must be made in this currency .

4.3 Additional Costs:

  • Shipping Costs: Delivery charges are not included in the product price and will be shown at checkout before you place your Order .
  • Customs and Duties: For international orders, you may be subject to import duties, taxes, and customs brokerage fees upon arrival in your country. These charges are your responsibility and are not included in the price or shipping cost paid to us . We advise you to contact your local customs office for more information.

4.4 Payment Methods: We accept the following payment methods :

4.5 Payment Processing: Payment must be made at the time of placing your Order. We must receive full and cleared funds before dispatch of Goods .

4.6 Deposits: If we agree that you can pay by initial deposit, the balance must be paid in full within [14 days] of our receipt of the deposit. If we do not receive the balance payment, we reserve the right to cancel your Order and relist the Goods .

5. DELIVERY

5.1 Delivery Locations: We ship worldwide. We do not ship to the following countries like Iran, North Korea due to sanctions or shipping restrictions] .

5.2 Delivery Times:

  • Domestic Orders: [e.g., 2-5 working days] from Order Confirmation .
  • International Orders: [e.g., 7-14 working days] from Order Confirmation, though this is an estimate and not guaranteed .

All delivery times are estimates and may be affected by Events Outside Our Control .

5.3 Delivery Charges: Shipping costs are displayed at checkout and depend on your location and chosen shipping method .

5.4 Tracking: Once your Order is dispatched, we will send you a shipping confirmation email with carrier details and tracking information .

5.5 Delivery Address: You are responsible for providing accurate delivery information. If Goods are delivered to an incorrect address provided by you, any cost to redirect or reship will be your responsibility .

5.6 Receipt of Goods:

  • Upon delivery, please inspect the package with the carrier .
  • If the package appears damaged or opened, note “subject to unpacking” on the delivery receipt and open it in front of the carrier if possible .
  • If you are unavailable at delivery, the carrier will leave a notice with instructions for rescheduling or collection .

5.7 Risk and Title: The risk of loss or damage to Goods passes to you upon delivery. We retain ownership of the Goods until we receive full payment .

6. RIGHT OF WITHDRAWAL (RETURNS FOR REFUND)

6.1 Cooling-Off Period: As a consumer, you have the right to withdraw from your purchase within 14 calendar days without giving any reason . This period expires 14 days after the day you (or a person named by you) receive the Goods.

6.2 Exercising Your Right: To exercise this right, you must inform us of your decision by a clear statement:

You may use the model withdrawal form below, but this is not mandatory .

6.3 Effect of Withdrawal: If you withdraw from the Contract, we will reimburse all payments received from you, including standard delivery costs (but not any upgraded shipping you chose), within 14 days of receiving the returned Goods or proof of return .

6.4 Return Condition: To receive a full refund, Goods must be returned :

  • In their original condition (unworn, unaltered, and unused)
  • With all original packaging, tags, stickers, and documentation
  • Within 14 days of notifying us of withdrawal

Important: Watches are delicate items. Even brief wear can show signs of use. Please try on watches carefully over a soft surface and return them in the same condition you received them .

6.5 Return Shipping Cost: You will bear the direct cost of returning the Goods unless the return is due to our error (e.g., wrong or defective item) .

6.6 Deduction for Diminished Value: If the value of the Goods has diminished because you handled them beyond what is necessary to establish their nature, characteristics, and functioning (e.g., wearing them outside, removing protective stickers, resizing the bracelet), we may deduct an amount from your refund .

We recommend using a tracked delivery service with insurance, as we cannot be responsible for items lost in return transit .

7. RETURNS FOR DEFECTIVE OR NON-CONFORMING GOODS

7.1 Inspection on Receipt: You should inspect the Goods immediately upon receipt. If Goods are defective or do not conform to your Order, please notify us as soon as possible .

7.2 Legal Warranty: We are responsible for any lack of conformity that exists at the time of delivery and becomes apparent within [2 years] from delivery . During the first [year/6 months], it is presumed the defect existed at delivery unless we can prove otherwise.

7.3 Remedies: If Goods are defective or non-conforming :

  • We will repair or replace the Goods, or
  • If repair or replacement is impossible or disproportionate, we will refund the purchase price.

7.4 Return for Defective Goods: If we confirm the Goods are defective, we will bear the cost of return and organize the return shipping .

7.5 Warranty Exclusions: The warranty does not cover :

  • Normal wear and tear (scratches, fading of straps, etc.)
  • Damage from improper use, accidents, or neglect
  • Damage from unauthorized service or repair
  • Water damage if water resistance specifications were not followed
  • Battery life (for quartz watches)

8. RESERVATION OF OWNERSHIP

8.1 Retention of Title: The Goods remain our property until full payment has been received .

8.2 Before Title Passes: Until ownership passes to you, you must:

  • Store the Goods separately and properly
  • Not remove any identifying marks
  • Keep the Goods insured
  • Not sell or dispose of the Goods

9. LIABILITY

9.1 Our Liability: Nothing in these Terms excludes or limits our liability for:

  • Death or personal injury caused by our negligence
  • Fraud or fraudulent misrepresentation
  • Any other liability that cannot be excluded or limited by applicable law .

9.2 Limitation of Liability: Subject to section 9.1, to the extent permitted by law, our maximum liability to you for any claim arising from or related to these Terms or your purchase shall not exceed the purchase price you paid for the Goods .

9.3 Business Customers: If you are purchasing as a business, we shall not be liable for any indirect or consequential loss, loss of profit, loss of business, or business interruption.

10. INTELLECTUAL PROPERTY

10.1 Ownership: All content on our Site, including text, graphics, logos, images, videos, and software, is our property or the property of our licensors and is protected by intellectual property laws .

10.2 Use: You may not reproduce, distribute, modify, or commercially exploit any content from our Site without our written permission.

10.3 Trademarks: “Atlas Time Enterprise,” “Carry Your World,” and our logo are our trademarks. Other trademarks, brand names, and product names appearing on our Site are the property of their respective owners.

11. YOUR INFORMATION AND PRIVACY

11.1 Privacy Policy: Your personal information will be processed in accordance with our Privacy Policy, which is available on our Site .

11.2 Marketing Communications: With your consent, we may send you newsletters and promotional offers. You can opt out at any time by clicking the “unsubscribe” link in any email .

12. PROHIBITED RESALES

12.1 No Unauthorized Resale: Our Goods are intended for personal use only. You may not resell our Goods through any online marketplace (including but not limited to eBay, Amazon, Facebook Marketplace) without our express written authorization .

12.2 Commercial Accounts: If you wish to purchase for resale, please contact us to discuss wholesale terms.

13. FORCE MAJEURE

13.1 Events Outside Our Control: We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under a Contract caused by an Event Outside Our Control .

13.2 Definition: An Event Outside Our Control includes any act, event, non-happening, omission, or accident beyond our reasonable control, including but not limited to:

  • Strikes, lock-outs, or other industrial action
  • Civil commotion, riot, invasion, terrorist attack, or threat of such
  • Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or other natural disaster
  • Impossibility of using public or private telecommunications networks
  • Acts, decrees, legislation, regulations, or restrictions of any government 

13.3 Our Obligations: If an Event Outside Our Control affects our performance of our obligations:

  • We will contact you as soon as reasonably possible to notify you
  • Our obligations will be suspended, and the time for performance will be extended for the duration of the event
  • If the event continues for more than [30 days], you may cancel the Contract and we will refund any sums you have paid

14. GOVERNING LAW AND JURISDICTION

15.3 Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment: You may not transfer your rights or obligations under these Terms without our written consent. We may transfer our rights and obligations to another organization, but this will not affect your rights under these Terms.

15.5 Third Party Rights: These Terms do not create any rights enforceable by any person who is not a party to them.

We may update these Terms from time to time to reflect changes in our practices, legal requirements, or for operational reasons. The current version will always be posted on our Site with the “Last Updated” date. Changes will apply to all orders placed after the updated Terms are posted .
